1. Introduction

These Terms of Service (“Terms”) govern your use of the website, training services, customer portal, and any related services provided by Phoenix Industry Training Solutions.

By accessing the website, making a booking, or using services, you agree to these Terms. If you do not agree, please avoid using the website or services.

2. About Us

Phoenix Industry Solutions is located in Northern Ireland. Contact: info@phoenixindsolutions.com. We specialise in accredited industrial training, including but not limited to: forklift training, warehouse equipment, MEWPs, vehicle operation, assessments, and refresher certifications.

3. Training Services

Accreditation: Training aligns with industry standards and accrediting bodies like ITSSAR. Certifications are awarded only when participants meet required competency standards.

Course Requirements: Participants must be physically fit, wear appropriate PPE, follow instructor guidance, provide accurate information, and meet literacy and numeracy standards. We reserve the right to refuse training if safety is compromised.

Certification: Certificates are issued only when trainees attend all required sessions, demonstrate competency, and pass assessments. Certificate replacement may incur administration fees.

4. Bookings, Payments & Cancellations

Bookings: Made via website, email, phone, or corporate account. Confirmation requires written acknowledgment.

Payment Terms: Payment must be made prior to training unless otherwise agreed. Corporate clients may receive invoices under agreed terms. Late payment may suspend training services.

Cancellations: Cancellations within 7 days may incur fees. Cancellations within 48 hours are charged in full. Non-attendance is charged fully. Rescheduling depends on availability.

We may cancel or reschedule due to instructor illness, severe weather, site safety concerns, or insufficient delegate numbers. Cancellations by us result in new dates or full refunds.

5. Delegates & Conduct

All delegates must comply with health and safety rules, instructor guidance, site procedures, and equipment policies. We reserve the right to remove any delegate who creates a safety risk, behaves inappropriately, or is suspected of being under the influence of alcohol or drugs. No refunds apply to removal based on safety or misconduct.

6. Liability

General Liability: We are not liable for loss of earnings, travel costs, accommodation costs, or consequential or indirect losses.

Training Environment: Training involves physical activity and machinery. Delegates participate at their own risk despite reasonable precautions.

Client Responsibilities: Where training occurs at client sites, the client is responsible for safe equipment, suitable training space, required PPE, and site-specific risk assessments. We are not responsible for unsafe client-provided equipment.

7. Website Use

Users agree not to attempt unauthorised system access, upload malicious code, copy content without permission, or misuse contact forms or portal logins. Website content is informational and subject to change.

8. Customer Portal

Users with login credentials must keep them secure and access only authorised information. Users are responsible for account actions. Access may be suspended for suspected misuse. The portal stores training history, certificates, and delegate information.

9. Data Protection

10. Intellectual Property

All website content, images, branding, training materials, and documentation remain the property of Phoenix Industry Solutions. Users cannot copy, reproduce, modify, or distribute content without written permission.
